This paper analyses a sentence of Constitutional Court pronouncing as unattainable a rule considered unconstitutional and as an infringement of various articles of CPN. Author refers to Aristotle to explain how particular justice splits in two: distributive justice and corrective justice, this last one labeled by Saint Thomas as commutative. Topic is examined by appealing to this justice principie, and presenting a particular case contents explain terms such as legal development, compensation, incentive, proportionality, stimulus, and some others to approach concern on distributive justice and proportional equity.
