ANALISIS ESTADISTICO DE PROCESOS EN COBRO COACTIVO POR SANCIONES DE INFRACCIONES AL TRANSITO PARA EL PERIODO DE AGOSTO DE 2016 A ENERO DE 2017 DEL DEPARTAMENTO ADMINISTRATIVO DE TRANSITO Y TRANSPORTE ( DATT)
Article 5 of Law 1066 of 2006, states that “Public entities that are permanently in charge of the exercise of administrative activities and functions or the provision of services of the Colombian State and that by virtue of these have to collect income or public flows, of the national, territorial level, including autonomous bodies and entities with special regime granted by the Political Constitution, have coercive jurisdiction to enforce the obligations enforceable in their favor and, for these purposes, they must follow the procedure described in the Tax Statute ”. (LAW 1066 OF 2006, 2006) The Administrative Department of Transit and Transportation, being a unit attached to the office of the Governor of Tolima, has as its main function to work for the regulation, organization and mobility of transit and transport on the roads of the Department of Tolima, this function and its development is leveraged for the income from concepts of appendixes, which are an income assigned by the nation to the territorial entities so that they directly carry out their management. The DATT as transit agency is vested with coercive jurisdiction for the collection of sanctions when necessary, which is established in law 769 of 2002 in article 159, modified by art. 26, Law 1383 of 2010, Modified by art. 206, National Decree 019 of 2012. Among the processes carried out by this transit authority is the coercive administrative process, which according to the above can be defined as the administrative procedure in charge of the collection and recovery of the department's portfolio administrative of transit and transport of Tolima DATT, by concept of the debts for sanctions of infractions to the transit, and its competence to manage it is expressed in article 8 of decree 1557 of 2016. Within the different stages that structure the process of coercive collection of debts in favor of the public treasury for different concepts, including fines for infractions, the payment order is initially found, this act orders the cancellation of outstanding obligations plus respective interests, which is personally notified to the debtor, and the previous summons is made so that it appears in a final term, and some exceptions against it arise. The present work directs the performance of a statistical analysis that initially compiles the information of users in a state of coercive collection present in the local databases of the period from August 2016 to January 2017, which will be updated regarding the Novelty of status presented by users, this initiative provides as an annex the graphing and analysis of the most frequent infractions committed by these users, the aforementioned will allow detailing the variables that allow decision making and the implementation of important strategies and institutional weight for DATT In this way, the objective of the project is to contribute to the improvement of the DATT coercive collection process based on the analysis of statistical information that leads to the best decision-making regarding the management of the portfolio. The choice of the subject arises from the needs present in the Administrative Department of Transit and Transportation of Tolima, and as an action to solve the problem, a statistical analysis is established taking as an initial reference the databases with user information in a state of Existing coercive collection, which for the present will be the period between August 2016 and January 2017, carrying out its update on the state news and therefore its constitution and systematization in the SIMIT technology platform, which will be a contribution in the update of the processes, the graphs and analysis of the results will be annexed regarding the most concurrent infractions in these users, which will allow the structural improvement in the progress of the coercive process and that for the direction of Transit and Transportation will be a basis in decision making, reporting, income certification The process left the Department and the implementation of organizational and operational strategies.
