espanolEl trasplante de instituciones juridicas que se tratara en adelante, se manifiesta en las diversas areas del derecho, sin embargo, dadas limitaciones de espacio, solo se llevara a cabo un estudio sobre el sistema procesal penal acusatorio estadounidense, y en especial del estandar de prueba en el concebido de “mas alla de toda duda razonable”. Debe aclararse que se comparte la necesidad de que en los ordenamientos juridicos se trasplanten figuras ajenas a sus propias elaboraciones, no obstante, los mecanismos de seleccion de dichos fenomenos parecen obedecer a logicas de globalizacion que se enmarcan dentro de una mas de las exigencias de orden economico mundial y de uniformidad de los sistemas procesales de todo el mundo. En este sentido el texto se desarrollara de la siguiente forma: En primer lugar, se reflexionara en torno a la cultura juridica, la descripcion de los trasplantes juridicos, la incidencia de la globalizacion en estos, asi como de las reformas juridicas y penales en Latinoamerica; por ultimo, se hara alusion al estandar de prueba “mas alla de toda duda razonable”, y algunas problematicas que giran en torno al mismo.
