El presente articulo tiene como proposito analizar la presencia estatal en el nivel local tomando como caso de estudio el municipio de El Carmen de Bolivar, Colombia. En el se realizan, por un lado, descripciones tendientes a la identificacion de instituciones ubicadas en el territorio municipal y el encuadramiento funcional de las autoridades en ejercicio, y, por otro lado, se analizan la produccion normativa local, concentrando la atencion en la Alcaldia y el Concejo municipales, ademas, del trafico juridico que fluye en la Notaria Unica, la Oficina de Registro de Instrumentos Publicos, el comercio formal y la Inspeccion de Policia. Sostendremos, a manera de reflexion final que, estos topicos dan una idea global de la presencia estatal en el municipio, al tiempo que permiten acceder a informacion util y pertinente sobre la institucionalidad local. Pero, tal metodologia no permite observar la presencia estatal con un mayor nivel de detalles. El analisis de la presencia estatal debe renunciar a la pretension de descripcion global de las instituciones y funciones del Estado, o, en el mejor de los casos, dicha pretension de descripcion global debe tomarse como el ejercicio preliminar de una estrategia metodologica diferente que incluya elementos evaluativos.Palabras Clave: El Carmen de Bolivar, Estado, Instituciones, Derecho, Positivismo juridico ABSTRACTAPPROXIMATION TO STATE PHENOMENON IN THE MUNICIPALITIES. EL CARMEN DE BOLIVAR: CASE OF STUDYThe following document has the purpose to analyze and study the state presence in the city, taking El Carmen the Bolivar municipality into account, located in Colombia as an example. On the one hand, to carry out this study, the people who are taking part of this are making descriptions tending to identify the different Institutions and the local authorities located in the territory of El Carmen the Bolivar. On the other hand, they are analyzing the local normative production, specifi cally in the city council, besides the legal system in the Unique Registry Offi ce, the Public Instruments Registry Offi ce, the regular trading and the Police Station. As a conclusion of this, these issues give a general idea of state presence in the city and they also let access important and useful information about local institutionallity in the city. However, such a methodology doesn´t let analyze the state presence in great detail and in depth. The analysis in state presence cannot give the global description of the Institutions and functions of the state in the country, in this case Colombia.
