Spanish Abstract: El presente trabajo compara la regulacion de la Responsabilidad de los Superiores Jerarquicos en el Derecho Internacional, en particular en el Derecho Internacional Penal y Humanitario, y su tratamiento en el Derecho colombiano, con particular atencion al Acuerdo de Paz entre el Gobierno de Colombia y las FARC y al Acto Legislativo 01/2017. Esta comparacion permite identificar toda una serie de diferencias, que son especialmente significativas en lo que se refiere a su aplicacion a los agentes del Estado, y que generan espacios de impunidad con respecto a los superiores militares y civiles que incumplen sus obligaciones de prevenir, reprimir o someter a la autoridad competente los crimenes internacionales por los que son responsables sus subordinados. Ante esta situacion, se presentan un conjunto de propuestas relativas a las fuentes normativas, el ambito de aplicacion y los elementos de la Responsabilidad del Superior, que se dirigen a reducir estos espacios de impunidad, en el entendido de que, de no abordarse adecuadamente los problemas identificados, correspondera a la Fiscalia de la Corte Penal Internacional determinar si procede a la apertura de una investigacion sobre la situacion en Colombia, cuyo fin seria adelantar actuaciones penales contra aquellos agentes estatales que sean considerados “maximos responsables” de crimenes de la jurisdiccion material de la CPI, y en particular de aquellas ejecuciones extrajudiciales denominadas “falsos positivos” English Abstract: The treatment of superior responsibility in Colombia departs significantly from its regulation under International Law, especially in relation to State agents. This situation has been worsened by the November 24, 2016 Peace Agreement between the Colombian Government and the FARC and Legislative Act 01/2017, which incorporates the Peace Agreement into Colombian Law. This is likely to generate an impunity gap for military and civilian superiors, who failed to comply with their obligations to prevent, suppress and submit to the competent authority the international crimes for which their subordinates are responsible. In light of this situation, a set of proposals regarding the sources of interpretation, the scope of application and the elements of superior responsibility under Colombian Law are put forward. The aim is to reduce the impunity gap, in the understanding that, if the problems identified in the treatment of superior responsibility under Colombian Law are not properly addressed, the Prosecutor of the International Criminal Court will have to decide whether to open an investigation into the situation in Colombia to investigate and prosecute the most responsible State agents for ICC crimes, including the extrajudicial killing known as “false positives”.
