Abstract:

Progress in the consolidation of fundamental rights and their guarantees in modern constitutional states has been significant; The tutelage mechanisms are integrated by an internal and international platform, the latter taking into account the criterion of subsidiarity and complementarity. The alternative procedures of the inter-American system, is one of the aspects that we believe generates greater complications in relation to compliance, is the lack of legislation to regulate the procedure to fully comply with the provisions of the American Convention itself and the interpretation of the same by the Inter-American Court of Human Rights in its judgments, advisory opinions or precautionary measures; Undoubtedly, this legal vacuum has a direct and negative impact on Mexican victims of serious violations of human rights; of all those who were deprived of their life, of their freedom, suffered physical and psychological violence, forced disappearance, those who have been exiled from their communities and displaced. Because this legal vacuum clearly and forcefully prevents victims from having effective and prompt access to justice and the restitution of violated human rights.
