Competencia de la Jurisdicción Especial para la Paz con relación a los miembros de la Policía Nacional que hayan cometido delitos relacionados con el conflicto armado colombiano
The purpose of this monograph is to analyze the jurisdiction of the Special Jurisdiction for Peace in relation to members of the National Police who have committed crimes related to the Colombian armed conflict; To this end, the starting point is the description of the referents that legitimize the investigation of the members of the National Police who have committed related crimes in the framework of the armed conflict, before the creation of the JEP; likewise, the scope of the judicial competence of the Special Jurisdiction for Peace to investigate members of the National Police who have committed crimes within the framework of the Colombian internal armed conflict is explained; and finally, the possible legal benefits that may derive from the legal competence of the Special Jurisdiction for Peace to hear the crimes committed by members of the National Police in the framework of the Colombian armed conflict are revealed. In this qualitative approach and developed under a hermeneutical method, it was possible to establish that although the members of the police are not amnestiable or pardonable subjects, they can receive certain benefits, as long as the police officer voluntarily requests their appearance before the JEP, and that court accepts your case as related to the conflict.
