This article presents the results of research conducted for the project “Estado de Emergencia Economica, Social y Ecologica en el derecho colombiano” [Colombian Law and the current Economic, Social and Ecological State of Emergency] between 2012 and 2013 at the Universidad de Cartagena. The objective of the research was to “specifically identify the theoretical and philosophical bases of the State of economic, social and ecological Emergency in Colombian Constitutional Jurisprudence”. To accomplish this, the theoretical and historical frameworks of states of emergency were analyzed, in particular the current State of economic, social and ecological Emergency in Colombia. Then, a jurisprudential line was developed for the constitutional review exercised by the Colombian Constitutional Court in the application of this legal construct. The findings reflected that between 1999 and 2011, the Court formulated various jurisprudential sub-rules to determine the constitutionality of decrees issued based on those constitutional moments of emergency. This article focuses particularly on the presentation of the results from this second line of review.
