Abstract:

Nowadays there is no consensus about the role that companies play in the protection, respect and guarantee of human rights. Since the 1970s, the international regulatory process has moved from voluntary measures to include binding obligations for companies in international human rights treaties. Although some progress has been made, a “regulation dilemma” remains, as regulation is still voluntary, and therefore it faces important obstacles of implementation and commitment on the part of the States and the companies. Given this situation, several multinational companies have resorted to innovative measures that come from the private sector, to force themselves to respect human rights through Global Framework Agreements, which leads us to ask whether these initiatives could contribute, from the private sector, to solving the regulatory problems faced by international law in business and human rights. Throughout this paper we will show the way in which the AMIs contribute to this development.
