In order to identify whether Decree 1174 of 2020 is effectively regulating a new social protection floors and if complies with the parameters of integrality as a guiding principle of the general social security system, the review of the ILO main social security guidelines was taken as a basis, such as the Convention 101 and Recommendation 202, among others, as well as assessments of labor experts on the subject, in order to reach a first approximation of the decree in relation to its positive and negative points, to conclude that the floor of social protection that is intended to regulate with Decree 1174 of 2020, does not impact informality and does not create a basis for the Social Protection Floor, because it does not meet the expectations and parameters defined in Recommendation 202 and Convention 102 of the ILO that promote the protection of all people under a comprehensive social protection system, which allows people to have protection, among others such as pension, which allows people to survive in their old age stage. The closest forecast of this decree indicates that informality will not decrease because when the rule comes into force, according to labor experts and taking into account the economic, social and political situation of the country, it will lead to a negative effect on the labor relationship on the income of the workers and therefore in their social protection, because the employers would seek savings in social security contributions; This is due to the fact that the alternative presented in the decree studied involves coverage from the social protection floor with health coverage through the subsidized scheme, in old age with a complementary system of savings and inclusive insurance for occupational risks of focused manner, thus prevailing the segmentation of the social security system.
