The Constitutional Court established that, in certain cases it is appropriate to establish a writ of protection against arbitration awards in national and international commercial arbitration. Therefore, in this monograph I shall analyze whether the application of the writ of protection against arbitration awards in national and international commercial arbitration may compromise the effectiveness of party autonomy, which is the cornerstone of the institution.
