espanolEn octubre de 2012 se iniciaron las negociaciones entre el gobierno Santos y la guerrilla de las FARC-EP en la ciudad de La Habana, Cuba, para buscar salidas que permitan la finalizacion definitiva del conflicto armado interno que ha azotado a Colombia por mas de 40 anos. La brujula de este nuevo intento de paz es una agenda presentada por el gobierno que contiene 5 puntos que giran en torno a la redistribucion de la tierra, al desarrollo agricola, al fin de la guerra y del narcotrafico y a los derechos a la verdad y a la oposicion politica. Se sostiene que la justicia transicional que se establecera en Colombia es atipica, ya que se implementara en medio del conflicto armado. Para el desarrollo del texto se utilizo el metodo bibliografico o documental que consistio en recopilar, organizar, sistematizar y analizar la informacion encontrada en libros, sentencias, articulos, etc., sobre la justicia transicional y el conflicto armado interno en Colombia. Como conclusion se dira que el Estado colombiano, especialmente su democracia, se encuentra en una profunda transformacion que implicara asumir un costo politico para obtener el tan anhelado derecho fundamental a la paz. EnglishNegotiations between the Santos’ government and the FARC-EP began in October 2012 La Habana, Cuba, to try to find solutions that allow the final completion of the internal armed conflict that has devastated Colombia for over 40 years. The compass of this new attempt for peace is an agenda designed by the government which contains 5 points that revolve around land redistribution, agricultural development, the end of the war and drug trafficking, and the right to truth and political opposition. It is argued that transitional justice to be established in Colombia is atypical, and to be implemented in the midst of the armed conflict. The text bibliographic or documentary method was used for the development of the text which consisted of collecting, organizing and analyzing information found in books, statements, articles, etc., about transitional justice and the internal armed conflict in Colombia. In conclusion will be said that the Colombian State, especially its democracy is in a profound transformation that involves taking a political cost in order to obtain the longed fundamental right to peace.
