RESUMO: Este artigo ressalta o Incidente de Resolucao de Demandas Repetitivas (IRDR) como um instrumento capaz de harmonizar jurisprudencias a serem observadas por juizes e tribunais patrios. A despeito de Controversias havidas quanto ao efeito vinculante deste instrumento juridico, o IRDR vem se consolidando, a partir dos aspectos filosofico-juridicos que o integram, como uma ferramenta de promocao de efetividade jurisdicional, decorrente de abalizada seguranca juridica, lastreada na observância de requisitos Dworkinianos de estabilidade, integridade e coerencia, explicitados, sobretudo, no artigo 926 e consubstanciado no instituto juridico do artigo 976 do Codigo de Processo Civil de 2015. Tal instituto encontra, ainda, suporte em principios criteriosamente objetivados, decorrentes do pragmatismo norteador de precedentes considerados a partir de circunstâncias faticas. INTEGRITY AND CONSISTENCY IN THE LIGHT OF THE DWORKINIAN THEORY AGAINST THE PRAGMATISM OF THE LEGAL INSTITUTE OF THE REPETITIVE DEMAND RESOLUTION ABSTRACT : This article highlights the Repetitive Demand Resolution Incident (IRDR) as an instrument capable of harmonizing jurisprudence to be observed by national judges and courts. Despite controversies regarding the binding effect of this legal instrument, the IRDR has been consolidating, from the philosophical-legal aspects that the integrate it, as a tool for promoting jurisdictional effectiveness, due to the weakened legal certainty, backed by compliance with Dworkinian requirements for stability, integrity and coherence, set out above all in article 926 and embodied in the legal institute of article 976 of the 2015 Code of Civil Procedure. Such an institute is also supported by carefully objectified principles, arising from the normal pragmatism of precedents considered from factual circumstances. KEYWORDS : Integrity. Coherence.
