The management of public resources, through the contractual activity of the State, is of vital importance in public management, to the extent that the achievement of the State's purposes depends on it. The contractual activity can not be alien to the principles of the administrative function contemplated in Article 209 of the Political Constitution, which are established as fundamental postulates of public management, with the purpose that the purposes of the State are fulfilled, of efficient, responsible, transparent and effective way. Our legislation in order to achieve the correct investment of public resources enshrined procedures that, framed within principles of constitutional and legal rank, whose purpose is to ensure the fair and equitable distribution of these, through the collaboration of individuals that under conditions of equality and impartiality they participate in the State's contractual activity. However, in the normative development of the contractual activity for the management of state resources and the search for the efficiency of public management, the Association Agreements figure escaped for more than 25 years, given that its origin was It goes back to the Political Constitution that enshrines them in its Article 355, regulated in its first stage by Decrees 777, 1403 of 1992 and 2459 of 1993 and currently by Decree 092 of 2017. Although the national Government, when issuing the decree 092 of 2017, made an attempt to harmonize the association agreements to the General Statute of public procurement and to the principles that govern it, was timid in the structuring of an own and autonomous selection process for this contractual typology and in determining in a specific criteria that guarantee the objective selection of the ESAL, more suitable and convenient for the fulfillment of the contractual object for the social benefit of the most vulnerable population with an efficient and effective public expenditure in development of its activity of promotion or promotion of non-profit organizations, for the full accomplishment of its mission of community service.
