The indebtedness of the Brazilian consumer complains different legislative treatment even more in crisis times. The Project of the Senate Law 283/2012 introduces obligations on credit providers, prevention mechanisms and extrajudicial and judicial treatment ofoverindebtedness of natural person, always aiming to guarantee the existential minimum and human dignity. Also establishing core conciliation and mediation of conflicts and debt renegotiation. The substitute bill presented to the Committee on Constitution and Justice of the Senate also brings important advances. Therefore, this study based on the deductive method, highlights the socioeconomic emergency of the Brazilian legal system enhancement to effectively deal with the current crisis.
