Abstract:

This writing makes an analysis of the unjust deprivation of the liberty to which any person who in criminal proceedings was exonerated of criminal liability pursuant to the principie of in dubio pro reo, as a cause or factor of attribution of non-contractual civil liability to the State. For this, the different positions that the Council of State has assumed, especially the one according to which, should be judged under the objective imputation regime using the special damage title, ore exarnined, in order to demonstrate that this is not the correct way to structure it, on the basis that it is necessary to assess the conduct of the judicial operator who ordered the restriction on freedom, because injustice is not automatically preached simply because it has a favourable criminal judgment, therefore the analysis of responsibility is not exhausted by the mere verification of deprivation of liberty and absolute judgment, but in any case it is necessary to demonstrate the breach of constitutional and legal duties by the person who imposed the measure, taking into account the way in which the facts occur turns out to be definitive in structuring the elements of responsibility.
