The causation constitutes one of the key components for the existence of civil liability. In Colombia, the Supreme Court of Justice has used different theories to identify the causality over time, with the aim of determining the linkage between an activity and the damage inflicted. Currently, this Corporation applies the theory of the adequate cause, which studies in a normality context, bearing in mind the rules of experience, the circumstances that may be considered as the causes of the damage suffered by an individual. In this document, the Court's jurisprudence will be compiled in order to analize the applicability of said theory and identify its difficulties. Lastly, it will be suggested to replace the theory of the adequate cause with an approach that properly suits the purpose of the causation in fact: the But For Test (also called Conditio Sine Qua Non).
