Interés superior del menor e integración normativa en la concesión de la prisión domiciliaria para el aforado cabeza de familia en la jurisdicción penal militar
Given the legal restrictions and conflicting pronouncements that existed between the Supreme Court of Justice and the Military Superior Court in front of the concession of the house arrest of the family head in the military criminal jurisdiction, the principles and norms that had to be incorporated to the Military Criminal Code, by way of the principle of integration, to grant the said subrogation in favor of the right of children to grow up in a family. Hence it was discussed, ?why the best interests of the minor forced the Superior Military Court to apply the principle of integration to grant house arrest to the father or mother head of family?, thus overcoming the problem of normative validity posed by Robert Alexy and Luis Recasens, for which the Delphi method was applied, where five experts were consulted to answer the research question that was asked.
