The way in which the State Council has addressed the state responsibility for terrorist acts has brought with a series of problems regarding the nature of the practice of extracontractual liability of rhe State, the role played by the causality and the legitimacy of the Council of State to establish that responsibility is the way through which the duties of assistance to victims of terrorism must be met; problems that are added to the old discussion on the foundation of the duty to reapir for terrorist acts. In this work, it is defended that the failure of the service is the foundation of the duty to repair state; which is a corollary of the corrective distributive nature of extrcontractual liability and the nature of an institution od common predicable benefit of the State; so that it is the legislator -not the judicial branch- the competent body to adopt the mechanisms of assistance to the victims of terrorism.
