Este trabalho articular reside nos campos historico, do Estado e do desenvolvimento social, e tem como mister analisar a Teoria da Ordem Espontânea sob a perspectiva de Friedrich Hayek e sua repercussao no direito de liberdade. Para alcancar o objetivo proposto far-se-a uma sinopse entranhada em teorias de varios pensadores, tais como: Edwin van de Haar, Carl Schmitt, Francis Fukuyama, Bernard Brodier, Byung-Chul Han, dentre outros, atraves de uma pesquisa bibliografica. As sociedades humanas sao regulares, de outro modo, os individuos nao seriam capazes de desvelar suas proprias vidas satisfazendo suas necessidades basicas. Ademais, sem essa regularidade, a cooperacao seria muito dificil; quica, impossivel. Essa regularidade obedece uma espontaneidade: uma ordem social. Que ordem e essa? Qual a sua natureza? E artificial ou natural? Conforme Hayek, essa ordem social e resultante das acoes humanas, e nao de suas intencoes. Dai a sua caracteristica de ser espontânea. A vida em sociedade se estabelece pelas condutas adotadas pelos individuos na busca pela cooperacao uns com os outros. Esse comportamento cooperativo somente e possivel porque, conforme Hayek, existe “uma correspondencia entre as intencoes e as expectativas que determinam as acoes de diferentes individuos” (1985, p.37) em comunidade. A harmonizacao entre as intencoes e expectativas dos diferentes individuos proporciona que a ordem social se manifeste no mundo sociavel atraves da liberdade economica. A ordem tem essa estrutura imprescindivel. Sem essa dimensao estruturante, as acoes humanas transcorreriam de forma desordenada e a humanidade extinguir-se-ia. FRIEDRICH HAYEK’S THEORY OF SPONTANEOUS ORDER: AN ANALYSIS OF LIBERTY AND THE RIGHT TO LIBERTY IN STATE POLICY ABSTRACT This paper intertwines historical, state and social development fields and aims at analyzing the Theory of Spontaneous Order under the perspective of Friedrich Hayek and its repercussion in the right to liberty. To achieve the proposed goal we will read the theory of many thinkers, such as: Edwin van De Haar, Carl Schmitt, Francis Fukuyama, Bernard Brodier, Byung-Chul Han, among others, through a bibliographic research. Human societies are regular; otherwise, the individuals would not be able to guard their own lives by satisfying their basic needs. Moreover, without this regularity, the cooperation would be very difficult, perhaps, impossible. This regularity obeys to one spontaneity: a social order. But, which order is this, what is its nature? Is it artificial or natural? According to Hayek, this social order is resulted by human actions and not by their intentions. That is the reason why it is spontaneous. Life in society is established by the adopted conducts of individuals in the search for cooperation with each other. This cooperative behavior is only possible because, according to Hayek, there is “one correspondence between the intentions and expectations that determines the actions of different individuals” (1985, p. 37) in the community. Harmonization between the intentions and expectations of the different individuals affords that the social order appears in the sociable world through the economic liberty. The order has this indispensable structure. Without this structural dimension, human actions would occur in a disorderly way and humanity would be extinguished.
