The application of paragraph 2 of Article 38 of Colombian Law 734 establishes a supervening disability for public servants, currently disparate concepts are presented in relation to the form of guilt of that rule. In response to this diversity of views on the subject, is to perform an analysis on the subject to question, discern and understand the approaches established; also strengthen conclusions consistent with the concepts and legal and jurisprudential parameters.
