This study analyzes public tendering policy in Colombia regarding infrastructure construction and focused on the management of micro and small civil engineering companies. For this, the public tendering policy regime has been examined since the publication of the Law # 19 in 1982 to the publication of the Decree # 1082 in 2015, which compiles the existing public tendering norms, under the socioeconomic circumstances of its enactment and considering the influence that free trade policies and globalization process have had in the promulgation of such laws. This analysis reveals the sequential conversion from a quasi-protectionist economic policy to a completely unrestricted one opened to free trade. Likewise, this study highlights the existing normativity intended to foster the creation of micro and small companies. The effect of the existing public tendering policy on this type of companies is verified analyzing the results from statistical processing of two samples. This allows to compare the financial conditions of construction companies against the specifications on proposals from public agencies. This work shows the negative impact produced by the implementation of neoliberal concepts without the required precautions that cornered and displaced micro and small engineering companies thus producing casualization on them.
