RESUMO: O presente artigo se propoe a analisar o PL no 4.302/1998, conhecido como “Reforma da Terceirizacao” e seus reflexos nas relacoes trabalhistas. O projeto de lei foi enviado durante o governo Fernando Henrique Cardoso, em 1998, e reaberto e votado no Congresso Nacional em 22 marco de 2017. O tema esta dividindo a sociedade quanto aos seus impactos sobre o mercado financeiro e de trabalho, fazendo com que uma maior discussao acerca do seu conteudo se torne necessaria. Alem disso, tambem sera discutido o Projeto de Lei no 4.330/2004 (posteriormente convertido no PLC no 30/2015, aprovado na Câmara), do Deputado Sandro Mabel (PL/GO), que visava legislar sobre a contratacao de servicos terceirizados para quaisquer atividades, desde que a empresa contratada esteja focada em uma atividade especifica, enquanto o PL da epoca de FHC estava em tramitacao. Dessa forma, esperamos esclarecer o conteudo da legislacao, alem de expor seus aspectos positivos e negativos mais salientes, para que a sociedade possa compreende-la, e entender os seus impactos no mercado financeiro e de trabalho. ABSTRACT: This article aims to make an analysis of the “PL n° 4302/1998”, also known as the “Outsourcing Reform Bill”, and discuss its consequences for labor relations. The Bill was first discussed during Fernando Henrique Cardoso's administration, in 1998, and has been once again brought up to light by the Congress at March 22nd, 2017. This theme constitutes a divisive matter especially when taken into consideration its impacts on the financial market and on job offering, therefore making a larger debate necessary about it. Furthermore, during the same period FHC’s project was being discussed, the “PLC no 4.330/2004” Bill (which was later converted into the “PLC n° 30/2015”, approved by the Congress in 2015) first proposed by Congressman Sandro Mabel (PL/GO) intending to regulate general outsourcing as long as the contracted company is focused solely on an specific activity, was also brought up to discussion. Thus, it is our goal to shed light on the referred Bills’ contents exposing its most relevant merits and flaws in a way that one can comprehend and enlist its impacts on job offerings, and on the financial market as a whole.
