La corrupcion se edifica como uno de los principales problemas en Colombia y como tal es hoy prioridad en la politica publica. La lucha eficiente contra este fenomeno obliga a la adopcion de herramientas que no se limiten a la persecucion o represion de la corrupcion sino que se enfoquen desde la prevencion a impedir que el comportamiento llegue a realizarse. A partir de un estudio analitico-descriptivo se presenta un diagnostico de las diferentes herramientas con que cuenta el Estado colombiano que favorecen la persecucion de activos ilicitos, en este caso concreto, provenientes de la corrupcion. De esta manera se senala la eficacia y suficiencia de estos, y su empleo y entendimiento efectivo por parte de las autoridades colombianas, y la importancia frente a una politica de prevencion de conductas de corrupcion ante la eliminacion de uno de los principales incentivos. Asi podemos identificar las oportunidades de mejora, para que apoyandonos en un metodo teleologico politico-criminal, realizar propuestas concretas para su mejoramiento. ABSTRACT Corruption is one of the main problems in Colombia and as such is today`s priority in public policy. However, an efficient way to combat this phenomenon implies the adoption of different tools that are not limited to “persecution” or “suppression” of corruption behavior, and are focus on the prevention of this kind of conducts in order to avoid the behavior to be performed. Using an analytical-descriptive methodology, this article presents a diagnosis of the different tools that are included in the Colombian State that favor the prosecution of illicit assets-in this concrete case that come from corruption, pointing out the effectiveness and adequacy of those, their employment and the effective understanding of them by the Colombian authorities, and the importance in front of a prevention policy against corruption through removing one of the main incentives; identifying the opportunities for improvement-on the basis of an teleological-criminal policy method, in order to make concrete proposals for its improvement.
