La construccion de una linea jurisprudencial se realiza a partir del estudio y analisis de un numero determinado de sentencias, emitidas, en lo pertinente para este estudio, por la Corte Constitucional, con el fin de determinar cuales han sido los pronunciamientos de esta Corporacion en cuanto a la proteccion de los derechos fundamentales - vulnerados a los estudiantes de primaria y secundaria por parte de las instituciones educativas – y establecer las diferencias y/o semejanzas entre los pronunciamientos promulgados en distintos periodos de tiempo. Para dar inicio a la construccion de la linea jurisprudencial se tomo un numero par de 20 sentencias y se dividieron en dos grupos: 10 sentencias entre 1993 a 1999, y 10 sentencias del ano 2000 al 2007, para conocer cambios en el comportamiento de la Corte Constitucional en los primeros anos de funcionamiento, asi como en un periodo reciente. Abstract Protection of the funda mental rights, of the students primary and high school, by the constitucional colombian court The construction of a jurisprudence survey is done by performing a study and analysis of a determined number of sentences, passed, in our particular case by the Constitutional Court of Colombia, so as to determine which pronouncements have there been from this Court, with regard to the effective protection of the fundamental rights as stipulated in the Colombian constitution of 1991 – the rights of the students of both primary and secondary schools which have not been respected by the respective educational institutions – and establish the differences and/or similarities of the judgements that have been passed in different periods of time. The jurisprudence survey is composed of the even amount of 20 sentences (judgements) which were divided in two groups: ten sentences passed between the years of 1993 and 1999 and ten sentences passed between the years 2000 and 2007. This division is made as to register the changes in the behaviour of the Constitutional Court in its first years of operation as well as in a more recent period.
