Durante los ultimos cincuenta anos se ha vuelto una constante en nuestro pais, que cada vez que ocurre una situacion coyuntural donde predomine la excesiva crueldad, el derramamiento de sangre o la degradacion del ser humano, resurja la necesidad de aumentar las penas. Tal respuesta estatal, mas la creacion de nuevos tipos penales, no reflejan verdaderas pautas de politica criminal que determinen las causas reales de los grandes incrementos de la criminalidad y contrarresten los altos indices de impunidad reinantes en Colombia. Abstract During the last fifty years the necessity of increasing the penalties has become in a constant in our country. It occurs each time that a situation where the excessive cruelty, bloodshed or the degradation of the human beings predominates. That state response, plus the creation of new types of punishments do not reflect a model of criminal politics to determine the real causes of the big increase of criminal cases and to thwart the high impunity rates in Colombia.
