Para brindarles a los particulares medios idoneos para su desenvolvimiento en la sociedad, el constituyente a traves del articulo 23 de la Carta Politica actual, elevado a derecho fundamental, le otorga a las personas la posibilidad de impulsar la actividad del Estado y a obtener pronta respuesta a las peticiones formuladas. Sin embargo es posible que las autoridades administrativas omitan responder dentro del termino establecido, por lo que se configuraria el silencio administrativo; esta es una garantia que se establecio a favor de los peticionarios con el fin de asegurar la efectividad de los derechos constitucionales de peticion (Art. 23 C.P.) y acceso a la administracion de justicia (Art. 229 C.P.). La jurisprudencia y la doctrina en algunos casos conceptua que el silencio administrativo se constituye en una “ficcion legal”, establecida en garantia de los administrados y por otro lado lo asume como la categoria juridica de presuncion, acto que se conoce como “acto presunto o ficto”. Las posiciones anteriores tienen algunos matices que separan estos terminos y que es importante su claridad. Abstract For offering to the people suitable means for their development in society, the constituent assembly through the 23rd article of the current constitution gives to the people the possibility of driving the state’s activities to obtain a soon answer to the formulated requests. However, it is possible that the administrative authorities omit answering on the time specified by the rules. It is the reason why the administrative silence gets configured. This is a guarantee that is in favor of the petitioners to ensure the effectiveness of the constitutional petition rights (Art. 23rd P.C.) and access to the justice administration (Art. 229th P.C.). Jurisprudence and doctrine in some cases say that the administrative silence constitutes a “legal fiction”. This “legal fiction” is established as a guarantee for the administered people. On the other hand the “legal fiction” assumes the administrative silence as the legal category of presumption that is known as “presumed act or fake”. The stances presented before have some nuances that separate those terms and it is important its clarity.
