Los textos de las primeras constituciones francesas entre 1789 y 1870, que regularon elestado de sitio, tienen una notoria influencia en el contenido que sobre la misma materiase encuentran en las sucesivas cartas politicas colombianas especialmente en la que,promulgada en 1886, con sus reformas durante el Siglo XX, sirve como antecedente a laConstitucion Politica de 1991. Esta afirmacion no puede, en cambio, extenderse al estadode emergencia economica introducido en Colombia por el Acto legislativo No 1 de 1968.Aun cuando no se encuentran normas similares en la Constitucion de los Estados Unidosde Norte-America a las cuales pueda atribuirse influencia, es evidente que en momentosde crisis varios presidentes hicieron uso de poderes exorbitantes que pudieron llegar aconstituir violaciones de la constitucion pero que el congreso, como se vera, dejo pasar ensu momento como tipica muestra del pragmatismo norteamericano.
