New technology, especially biotechnology and the creation of new medicines, represents a difficult legal task for the European Union (EU). There are interests that conflicts with each other: the protection of the internal market and health care, prevent and treat illness, ensure a competitive and sustainable future for the EU, and even more sovereignty of Member States. This essay aims to discus different legal aspects that surround the regulation on new technologies in the EU. It describes and analyses norms, bodies and conflicts between them. Special attention is paid to the European Patent System and the Marketing Authorization (MA).
