This article aims to address the problem that is originated in Colombia by the implementation of the “Regional Program of water supply and sanitation,” caused by the lack of clearness on the legal regime that subsumes the contracts developed in order to perform them, signed by the program Manager. The government has tried to resolve this problem by the expedition of a new administrative rule, but in our opinion, it has failed because the rule is ineffective, vague and anti-technical. On the other hand, this paper proposes a constitutionally permissible solution to the problem, which harmonizes the provisions of the Regional Program of water supply and sanitation, with the industry standards of public services and these in turn with the rules applicable to procurement public entities.
