Abstract The parties to a contract formation process should avoid causing any damage and if it happens, the party that violates the right of the other must compensate the injured party. In this article, the reader will nd the most relevant aspects of the regulation of pre-contractual responsibility in Co-lombia, and its regulation in the European legal system and the U.S. including their legal nature and the various hypotheses structured around this type of responsibility. Resumen Las partes en un proceso de formacion de con-trato deben evitar causarse cualquier dano y si ocurriera, la parte que lesiona el derecho de la otra debera compensar a la parte lesionada. En este articulo el lector encontrara los aspectos mas relevantes sobre la regulacion de responsabilidad precontractual en Colombia, y su regulacion en el sistema legal europeo y en el americano incluyen-do su naturaleza juridica y las diferentes hipotesis estructuradas en torno a este tipo de responsabi-lidad civil.
