Abstract:

The purpose of this article is to compare and make a contrast, according to national and international case law and doctrine, between the two types of contracts commonly used for the carriage of goods by sea, such as the charter party and the bill of lading contracts. This comparison is aimed at identifying the legal regimen applicable to each type of contract. In particular, reference will be made to their differences regarding their purpose, obligations, liabilities, time bars and tax regime derived from the choice of one of these type of contracts.
