The aim of the present work is to describe the legislative evolution and the theoretical conception of the model of horizontal property in Colombia between 1948 and 2001, period in which one gave the birth and consolidation of this particular form of property. From 1948, and until the year 2001, three laws have been sent: 182 of 1948, 16 of 1985 and 675 of 2001. Each of these procedure there has approached from different theoretical approaches the model of horizontal property, in whom it has gone away of the model of community, company, juridical legal status, up to the current conception sui generis; these conceptions place in the evolution of the concept of private property and limit themselves in the political and social phenomena through that the country has lived and that have led to the redesign of the urban development landscape of the Colombian cities.
