La justicia transicional no es un tipo de justicia en el estricto sentido de esta palabra, se trata mas bien de un campo teorico-practico multidisciplinario dirigido a resolver los dilemas que enfrentan las sociedades que intentan superar su pasado violento. Esta contribucion tratara brevemente de identificar los elementos de la justicia transicional y los problemas que esta enfrenta, haciendo una mencion especial del impulso que han tenido los procesos de justicia transicional en America Latina gracias al desarrollo jurisprudencial de la Corte Interamericana. El enfasis radicara en los derechos a la verdad, la justicia y la reparacion, ampliamente estudiados por la Corte, y en la dicotomia que generan las leyes de amnistia.Transitional justice is not a category of justice in the strict sense of the word, it is rather a theoretical and empirical multidisciplinary field intended to resolve the dilemmas facing societies which try to overcome their violent past. This article will briefly identify the elements of transitional justice and the problems it faces. It especially mentions the contribution of the Inter American Court of Human Rights' jurisprudence to the transitional justice processes in Latin America. The emphasis will be put on the rights to truth, justice and reparation, which the Court has examined extensively, and the dichotomy generated by amnesty laws.
