The investigation was made in order to analyze the inequality procedure for claim for the benefits from antiquity to the public worker in front of the principles of law. This revised assumptions regarding the categories of study, which were made by different authors, among which are: Pla (1998), Garcia (2005), Casal (2006), Jaime (2008) and Perdomo (2002), among others. The investigation was documentary and descriptive type, with a design bibliographic. Documentary sources were used various legal doctrines primary and national and international primary and / or secondary. The technique for collecting information was the documentary observation. Four indents were designed to measure
