This article discusses the scope and limits of the duty of disclosure, for which it is established that the duty of disclosure is an obligation under the good faith, and its compliance allows full use of contractual freedom in deciding the convenience of the business, prevent risks, determine the extent of the obligations and rights assumed. It is also established that the information provided must be clear, timely and transparent so that the duty of disclosure is met in a substantial manner, and not merely formal. Finally, the author reveals the limits imposed by good faith to the duty to inform, in order to give content, efficiency and accuracy to this duty.
