The constitutional and legislative bases of the State’s patrimonial responsibility in Colombia are closely linked to the dogmatic and historical antecedents of our own reality. It we are to refer to origins, we will undoubtedly have to like wise talk about the constitutional bases that took roots in our country, before approaching the necessary jurisprudence. As to the evolution of the State’s extra-contractual responsibility, it is already known as a mainly mixed jurisprudence between the Supreme Court of Justice and the State Council, which by all means, could not have been forwarded without the needed advances not only established by comparative law, but also by Colombian legislation and Constitution.
