The dynamic packages are a new form of boking travel services that move away from traditional forms of touristic services: individual services and package deals. Therefore, the Directive 90/314/ EEC and the Consolidated Draft of the General Law for the Protection of Consumers and User, do not contemplate it; these rules are adapted to regulate a market where tourists can adhere to travel conditions (destinations, dates, times ...) without being able to amend them. Having no specific rules applicable, their recruitment is currently a loophole in the Spanish law. This article is the result of research that aims to give clarity to tourism, determining the legal regime applicable to dynamic packages which, in turn, will help to establish their legal status and liability regime.
