espanolEl presente articulo fundamenta dos tesis principales; por un lado, parte de la idea que la ausencia de proteccion juridico constitucional a los migrantes �principalmente colombianos en Espana- se debe al proceso contemporaneo conocido como globalizacion y las contradicciones que dicho proceso entrana, principalmente en lo concerniente a la fundamentacion y garantia de los derechos humanos a las personas en movimiento y su no reconocimiento del derecho fundamental a la igualdad con relacion a los ciudadanos y nacionales de los paises de acogida, y por otra parte, este escrito pretende especificar las posibles causas de dicha discriminacion en el proceso global actual. EnglishThe current writing is based in two main thesis, one side, it departs from the idea of the absence of juridic � constitutional protection of the migrants � mainly colombians in spain � is due to the phenomenon known as globalization and the contradictions that are inherent to that process, mainly the topics that regard to fundamention and garanties of human rights of people in movement and the no-recognition to the human right of equality with relations to citizens and nationals of host countries, by the other hand, this writing pretends to specify the causes of that discrimination in the global process.
