The constitutional Colombian law, states in its article 90, that the State is responsible “with its patrimony for the damage caused by its public employees, due to lack of action, wrongful action or something of the kind”. Therefore, this essay tries to show the many different ways in which a public employee can make the State result responsible for their actions. Also, at the end, we will analyze some of the actions that the State has to protect itself from the wrongful doing or lack of action of its employees.
