From the jurisprudence of the State Council, it could be seen that there are some different standards, objective and subjective ones, that are being applied with the objective of determining the amount of the extrapatrimonial (or non-patrimonial) damages compensation to be recognised to the victims as a result of the State liability. These two varieties of rules coexist discordantly causing inequitable administrative judge's decisions as well as affecting the judicial certainty. Thus, this work is aimed to answer the following question: What are the standards that allow administrative judges to order similar compensations in cases with similar facts?
