Derecho colectivo a la moralidad judicial

Abstract:

The Colombian legal system has collective rights recognized by the Constitution and regulated by law. It stipulates, among others, the collective right to administrative morality, however, this right cannot be invoked with respect to actions of the other branches of public power other than the executive branch. Next, judicial morality will be studied where an historical contextualization of judicial morality from the philosophical perspective and in the construction of the Colombian legal system will be initially exposed; likewise, the social perceptions of judicial morality will be studied, playing there a preponderant element in the legitimation of the State; as a third element of study, the application of administrative morality will be taken into account, on which judicial morality will be based as a reference, given that both figures would fall on the exercise of the protection of collective rights and interests; Lately, the need to conceive in our legal system a tool similar to that of administrative morality, but in judicial morality, will be reflected. Finally, by way of conclusion, it will be explained why judicial morality has been implicitly recognized throughout philosophical conceptions and its material recognition as a figure or means of control is necessary.
