Adequate and Proximate Cause vs Scope of Liability: A Comparative Analysis Between the U.S. Third Restatement of Torts and Colombian Supreme Court Decisions from 2016 to 2018
This paper contrasts Colombian Supreme Court decisions from 2016 to 2018 with curren U.S. trends on proximate cause or scope of liability included in the Third Restatement of Torts. First, it provides a review of the changes the Third Restatement of Torts introduced to the proximate cause doctrine. Then, it presents an overview of the general aspects of Colombian Tort Law to provide the legal context surrounding the judicial decisions that will be analyzed. An independent section will be devoted to what, up to now, have been the functional equivalents in Colombia of the Scope of Liability doctrine. The paper also provides context on the Colombian Supreme Court, its jurisdiction, and the effect of its decisions. Lastly, the main part offers an analysis of decisions by the Colombian Supreme Court, which faced scope of liability issues, considering the recent shifts implemented in the Third Restatement of Torts. An appendix provides a translation of the main tort provisions of the Colombian Civil Code.
