Labor outsourcing has been adopted as a mechanism for contracting services and for the production of goods, turning it into a subcontracting practice in which human and labor rights are privatized, although the State is the actor in charge of playing a very important role within its duty of intermediation or regulation, it turns out not to be very efficient at the time of defining those guidelines that allow guaranteeing human rights under this type of contracting. In this sense, the objective of this research is to propose guidelines for the analysis of labor outsourcing in the context of the guarantee of human rights in the context of Santiago de Cali. Regarding the methodology, a qualitative research was carried out through the consultation of secondary sources. Finally, a proposal of guidelines for the analysis of labor outsourcing in the guarantee of human rights was made, which allows to contribute to the radiography of the contracting of legal and natural persons of the private sector for the guarantee of human rights in the urban and rural areas of a territory.
