This article aims at sparking a debate on how Andean competition law could be improved in order to contribute to environmental protection. Although regional competition law is currently distant from environmental issues, the discipline may well play a key role in protecting the environment in the countries that make up the Andean Community. Indeed, on the one hand, competition law can incentivize certain corporate behavior that is beneficial to environmental sustainability; and, on the other hand, it can prevent and sanction business activities that have harmful effects on the environment. This article points out several mechanisms that could enable this “greening” of competition law.
