Restricción legal de anular actos administrativos en las acciones populares vs. la construcción jurisprudencial de una tesis garantista que se rehúsa a desaparecer
With the issuance of Law 472 of 1998, the law that regulates popular and group actions in Colombia, a controversy began in the contentious-administrative jurisdiction, tending to specify the scope of the powers of the popular judge to rule on the legality of acts or contracts of the administration, in defense of collective rights or interests. In relation to administrative acts, the Consejo de Estado developed four jurisprudential lines that could be grouped into two theses: a broad thesis that admitted the possibility of annulling an administrative act when it violated a collective right and a restrictive thesis that denied that possibility. With regard to the new Code of Administrative Procedure, the legislator took care of solving the previous controversy by introducing an express prohibition of annulling acts and contracts in popular actions. However, this study will focus on demonstrating that, despite the aforementioned prohibition, the Consejo de Estado has continued to annul administrative acts without expressly ordering it.
