Currently, cyber risk insurance policies typically cover two categories of risks: (i) first party risks, also known as own losses and (ii) third party risks, also known as civil liability. Within the latter, one of the main risks to which companies are exposed is incurring in civil liability towards third parties or clients due to the leak or unauthorized disclosure of confidential information. However, this type of insurance policy does not have standard clauses to cover said risk. Therefore, they are insured by the usual coverages available in the market, such as: (i) liability for disclosure of information; (ii) responsibility for network security. That said, this document will be analyzing this risk specifically, as well as the scope of the existing coverage in cyber risk policies.
