The purpose of this study is to analyze the general issues of informed consent in the clinical activity, from an eminently legal perspective, and the way it operates in Colombia, Spain and Chile. Moreover, at the end of this article, it´s examined whether the breach of informed consent by the physician in charge of mental disorder patient’s caring generates a breach to the lex artis, which could eventually result in criminal liability for negligence of the health professional.
