The principle of primacy of the reality is that the existence of an employment relationship does not depend on the agreements made by the parties, or the appearance contractual or legal relationships subjective, but on the contrary, the real situation which is the worker and the employer, the reality of the facts to which it is connected and of the situations that arise regardless of the nomenclature used to defi ne the relationship. The scope of the principle rescues the existence of the employment relationship still on the willingness demonstrated by the parties and this is consistent with the inalienable character of labor rights and the protective nature of labor law.
