Democracy through ICT is an idea that has being improved in recent years, and as a new form of democracy that is under development is important its study. The objective of the research is to interpret the political and legal consequences of the implementation of direct democracy in Colombia through the tools offered by TICS. The methodological strategy used in this research is part of a descriptive and qualitative approach, basically those that are registered in the field within the scope of the hermeneutic method whose purpose is to understand and interpret phenomena, behaviors or normative elements; documentary analysis and surveys were used as techniques. The main conclusion reached is that Colombia is a country that is not yet prepared for a transition such as that raised in this research because moving from a representative democracy to a direct democracy through ICTS is a transition that requires essential guarantees which the Colombian State does not comply with and is still far from fulfilling them because achieving them represents a high expenditure for the public funds.
